Came with his mother Nellie and other Pennsylvania familes to the fort at
Louisville, KY after his father died. He served as a private in the Revolutionary
War in Lt. Horatio Claggestt's 3rd Company of MD, a regiment commanded by
Colonel Nathan Ramsey. His name appears on the roll date February 1778.
After his marriage to Mary Wise, he lived at Fort Beargrass in Louisville,
Kentucky and in 1796 moved to Indiana and lived in Clark County in the town of
Charlestown.

The Last Will & testement of Philip Daily
I Philip Daily of the Baptist Profession of religion and faith in our Lord Jesus Christ and
being of Sound mind and descision[?] but poorly in bodily health do publish the following
as my last will and testement.
In the first place as touching my worldly concerns it is my will that all my debts if any shall
be paid and also my funeral expences and Secondly as to my estate of every description
both real personal & mixed It is my will that it shall be disposed of in the manner following
to wit Item It is my will that the tract of land which I have in number Seventy three (No
73) in the Illinois grant supposed to contain one hundred acres - be equally divided
between my two daughters Mary Huckelberry & Charlotte T Boyers - Share alike. Item It
is my will that my Beloved wife Mary Daily shall have and receive annually the sum of one
hundred dollars in lieu of all dower and to be paid by My Sons David W, Philip & Eli
Daily for her Support during her life and to be considered as an annuity to be raised from
the estate devised to them by this will. Item It is my will that the home place where I now
live which includes all my land in (No 56) number fifty six and a small piece in (No 55)
Number fifty five of the Illinois grant be divided equally between my said three sons above
named David W, Philip & Eli Daily Subject to the payment of the said one hundred dollars
annually to my beloved wife during her natural life for her support as above Said and I
request of my two neighbors Ez?ra Kemp & John Norris to make an equal devise of said
land for my said sons, having requised? __ [a paper fold runs through this last line] the
value there of. Item it is my will that my Said wife Mary have liberty in addition to the
above devise to her to select at her election Such articles of personal estate to the amount
of thirty dollars - Item it is my will that all my estate excepting what is above divised and
disposed of which consists of my personal estate and a small tract of land on the Ohio
river which I purchased of David Tilferd and deed made by William T/F? Huff Supposed
to cotain [contain] fifteen acres - be sold by my executors here after named - for the best
price according to law. and after paying my last debts and funeral expence It is my will
that it shall be equally divided and paid over to the children of my daughters Catherine
Carr (who is now deceased-) and Elinor Appelgate when they shall respectively come to
lawful age or marry each one to draw an equal share individually. And also - It’s my will
that my Executors pay one dollar to my son Jacob Daily and one dollar to my Daughter
Elizabeth Field - for their portions in ful and also one dollar in ful to my daughter Elinor.
An Lastly I do appoint My Sons David W. Philip & Eli Daily my Lawful Executors of this
my last will and testement hereby revoking all others. As with my hand and Seal this 20th
day of february 1830

The Daily Family
Phillip Daily (dailey) was a Revolutionary War Soldier and served as private in the 3rd
MD regiment und Capt. Horation Cleggett, commanded by Co. Nathan Ramsey Feb.
1778. He was the son of Charles and Eleanor (Temple) Daily of Washington Co PA, but
formerly of MD. The will of Charles Daily probated 12 Aug 1783 in Washington Co PA
named his 6 sons Phillip, Charles,Jr,.Samuel, Nathan, George and John. Following the
death of Charles, his widow and at least 3 of his sons migrated with other families to
Louisville, KY. Records of that city show Charles jr, Phillip and John living there in
1789. Philip always said he was named after his grandfather Phillip and records are
obtainable of Philip Daily owning land in Washington co PA where he, too had migrated.
The marriage of Phillip and Mary Wise was nor recorded in Louisville un 2 Feb 1786, a
clerical delay that was often the case at this early date. Following their marrriage, they
lived at Fort Beargrass in Louisville before moving to Charleston IN. Here they acquired
much land and became prosperous. On 1 Jan 1790 under land patents between John Clark
of jefferson assignee of George Rogers Clark and Philip Daily of Illinois Grant sold to
philip daily land n.w. side of OH to officers of ILL Regiment. 250 acres
Phillip and Mary Wise Daily are buried in Cemetary '74 in the Dupont area of the powder
plant of about 2500 acres in Clark Co IN. It is erronously called '54 on the map. The
cemetery was named after section 74 of the Illinois Grant and is on land originally owned
by Phillip Daily. This land grant deed was signed by President James Madison in 1816.
When I visited the cemetery to search for the graves, I could go about only under guard. I
was jubilant to find the graves of Philip and Mary. They are marked with a single very tall
and beautiflul monument. One side reads

Daily. The father of David W. Daily removed from KY to IN in 1796 near Charlestown.
David W Daily b 16 Aug 1798 in a log house where father lived on old homestead. In
1801 father built a new house, first hewed house in this portion of southern In. David W
m. Mary A Shirley, daut of a pioneeer who lived near father's place pn Aug 1818, died
1878, funeral being 60th anniversary of his wedded life. He was the father of 11 children
all of whom lived to be grown. First white child born in Clark Co.
Phillip , jr will probated 3 May 1839 m. 8 Oct 1819 Delilah Athon. Buried on the State
Road leading to Madison In. His brother, David Wise Daily, wanted him buried at
cemetary '74. When David Wise sent for the remains, he found the grave had been
disturbed by medical students and the head of the body was gone. However it was later
recovered by David Wise.

In the Jefferson Co Ky court house is the followinf marriage bond:
Phillip Daily to Mary Wise, Bondsman Vallentine Weis s(igned) in g(erman) 2-2-1786.
David L. James, Judge of Charleston City Court, of Clark Co IN great, great grandson of
Philip and Mry wise daily shared many daily-wise fammily rcords with me many years
ago.
Mary wise's mother was Katie Franz and her father Valentine Wize. They were married in
Washington DC , then a fort. Katie Franz wise lived to be nearly 100 years old and is
buried in 74 graveyard on what was the daily land, clark co. valentine wise is buried in
KY between Middleburg KY and Charleston IN. Valentine and Katie franz wise's
children were Jacob, David and Mary.
Mary Wise was 12 years old when the family moved from MD. She remembered it well
and often told Grandma Mary Shirley Daily all about it. She said her father owned a large
farm and the king of England sent his men over and theytook all the stock save one cow.
They destroyed everything they could lay their hands on, and then left. They returned,
however, in a short time and dug up holes all over the land; in explanation they said they
were looking for gold. Some of the holes were large enough to bury a house in. On this
trip the men killed the soil for the family. they concluded it was useless for them to
remain there any longer as everything they would make , the king would send and get.
Valentine Wise was a man of good education and had a fine mind. He possessed a
number of fine large old books, which was rare in those days. People refered to these
books as "whole chests of bookds." Mary Wise's famly lived in MD, PA, VA and KY.
Mary wise's mother, Katie Franz was born on the Gernan side of the Rhine. In the Hall of
Records at Annapolis Md, under baptisms of Frederick Co Md, is that of Valentine Weisz
8 Nov 1854, son of Daniel and and Margaret ( ) Weisz. Peter another son of Daniel and
Margaret ( ) Weisz was baptized 2 Mar 1758. There may have been other children. At the
request of Valentine wise, a deed was recorded 19 aug 1797. I must share another specific
tradition give me by Grandmother Charlotte. She always claimed that Eleanor Daily's
mother was a Wise from Powell's valley, VA and a niece of the Governor Wise of that
state. however, the records of Governor Wiseshow no niece by that name. In lieu of the
aformentiond date, the marriage bond of Philip daily to mary wise showing valentine wise
wies her father as German, his birth record in the Md Hall of Records, the tombstone
inscription of mary wise, and census records showing Mary Wise to be german, I felt that
grandmother may have been mistaken. In defense of grandmothers memory, I have
otherwise always been able to bring her stories into relation with historical facts.
I must also impart a perplixing entry in the records of Judge David L James. Mary Shirley
( born 1798-died 1897), wife of David Wise Daily, sr and daughter in law of Philip and
Mary Wise daily sted in her later years that HER grandmother was Katie Franz of Paris,
France. To clarify this, Mary Shirley claimed her husband's grandmother was hers. I
would be well to use this last piece of information with caution

Show ye, that Philip Daily of Clark County I Territory have deposited in the
General Land Office, a Certificate of the Register of the Land Office at
Jeffersonville whereby it appears that full payment has been made for the
southeast quarter of section Five of township Three north of the baseline in
range Seven east of the second principal maridian line of the Lands directed to
be sold at Jeffersonville by the Act of Congress entitled "An Act providing for the
Sale of the Lands of the United States in the Territory north west of the Ohio,
and above the "mouth of Kentucky river," and of the Acts amendatory of the
same, There is granted by the United States unto the said Philip Dailey, the
quarter lot or sectionof Land above described: To have and to hold the said
quarter lot orsection of Land with Appurtenances, unto the said Philip Dailey his
heirs and assigns forever.
In testimony where of, I have caused these Letters to be made PATENT, and the
Seal of the General Land Office to be hereunto affixed.
Given under my hand at the City of Washington, the twenty eighth day of
