1853; by John Vogt & T. William Kethley, Jr.; vol. I; page 206.)
Birth date is based entirely on the assumption that he married
at about 25 years of age.
!PARENTS: Albemarle County Chancery Cause 1829-007;
Box 31; Library of Virginia. Also reflected in Loose Orphan
Bonds at the Albemarle Historical Society (Benjamin Martin,
son of Benjamin Martin, bond dated Nov. 2, 1829). That the
Benjamin Martin, son of Benjamin, in the chancery suit is
the same Benjamin Martin who married Sarah Yancey is
indicated by the following facts:
(1) One Caleb S. Abell was bondsman for the Martin-Yancey
marriage (per copy of the bond), and Caleb S. Abell was
bondsman for the marriages of two other children of Benjamin
Martin, Sr. (see notes under Caroline and Lindsay), and was
guardian for one of Benjamin's children in the chancery suit.
(2) Augustin Woodson married Nancy Martin, one of the
daughters of Benjamin Martin, Sr. (see notes under Nancy), and
one Linsay Woodson (perhaps brother of Augustin?) provided
security for Sarah [Yancey] Martin to become guardian for John
Martin, orphan of Benjamin, on August 2, 1852 (per Loose Bonds
at the Albemarle Historical Society).
!This Benjamin Martin apparently died before May 15, 1842. (See
note under Sarah G. Yancey re: the will of Martha H. Grayson.)
!An estate division of one Benjamin Martin was recorded on
October 1, 1849 (Albemarle County, Virginia; Will Book 19;
page 277). However, that was apparently the estate of this
Benjamin's *father* because (1) the division mentions one Joshua
W. Abell as receiving property from the estate, (2) Benjamin
Martin, father of this Benjamin, had a daughter (Caroline) who
married Joshua W. Abell (see notes under Caroline).
