Individual:
!BIRTH DATE/PLACE: Federal Census; 1860; Nelson County, Virginia;
page 700 (in the home of John CRISTOPHER). States that Samuel, age 76,
was born in Rockingham County. That this is my Samuel is indicated by
the fact that my Samuel was married in the same county in 1806, when
the Samuel in this census record would have been 21; and that Samuel and
his wife, Jane, were living in Nelson County in 1850 (page 240).
!FATHER: Journal of the House of Representatives of the United States;
Monday, January 18, 1836; page 204 ("Mr. Garland, of Virginia, presented
a petition of Samuel Gay, of Nelson county, in the State of Virginia, heir of
the late Dr. Samuel Gay, a soldier of the revolution, praying for the
commutation of half pay due to his father for revolutionary services.");
Journal of the House of Representatives of the United States; Wednesday,
February 25, 1846; page 460 ("By Mr. Leake: A memorial of Samuel Gay,
son and one of the heirs of Samuel Gay, deceased, of the State of Virginia,
who was a surgeon in the army of the revolutionary war, praying that the
commutation pay and land due to his deceased father may now be paid to
his heirs."). See also the file from Samuel Gay Administrator vs. United
States; Case No. 975 (United States Court of Claims 1857); National
Archives; Washington, D.C. That this Samuel Gay of Nelson County is my
Samuel Gay is indicated by the fact that my Samuel was living in Nelson
County around 1836, as shown by the following evidence:
1. In 1860, my Samuel Gay was living in Nelson County in the home of
John and Nancy CRISTOPHER, ages 43 and 50 (Federal Census; 1860;
Nelson Co.; page 700). Also in the household was Marcellas GAY, age 22.
The census record states that both Nancy Cristopher and Marcellas Gay
were born in Nelson County.
2. Marcellas Gay was a son of Samuel Gay (Page Co., Virginia Marriages
1831-1839; transcribed by Judy Campbell; online database formerly at
http://www.rootsweb.com/~vapage/). This marriage record states that
Marcellus C. Gay, age 33, was married on Nov. 17, 1868; that he was
born in Nelson County; and that his parents were Samuel and Jane Gay.
Thus, my Samuel Gay was definitely living in Nelson County in 1835,
when his son Marcellus was born.
3. The 1830 census for Nelson County includes one Samuel Gay, age
40-50, with a female, age 40-50, and several children (page 106). Given
that my Samuel was born about 1784, he would have been about 46 in 1830.
Also, one of the children in this household is listed as 15-20 years old, and
my Samuel H. Gay, son of my Samuel Gay, was born about 1813 (Augusta
County, Virginia; Death Register; 1879; line 12).
4. I have found no evidence that any other Samuel Gay was living in Nelson
County around 1836.
!The above entries from the House Journal are transcribed on the Library of
Congress's "American Memory" site, at
http://memory.loc.gov/ammem/amlaw/lwhj.html.
!MARRIAGE DATE/PLACE, BIRTH PLACE: Marriage Bonds;
Rockingham County, Virginia. (Also stated in Rockingham County
Marriages, 1778-1850, by John Vogt, Dewey call # 975.5922 Vog 1984.)
(That their son, Samuel H. Gay, was born in Rockingham County (per his
death record) is further evidence that this is the marriage record of his
parents.)
!The marriage bond calls him Samuel Gay Jr.
!DEATH DATE/PLACE: Inventory of the estate of Samuel Gay; Nelson
County, Virginia; Will Book L; page 456 (recorded Feb. 21, 1863). The
bill of sale is in Nelson Co. WB M:148 (recorded Feb. 15, 1864).
!Samuel was guardian of his sister-in-law, Ann Ireland, in 1813
(Rockingham County Marriages, 1778-1850; by John Vogt and T.
William Kethley, Jr.; page 325 (marriage of Ann Ireland)).
!Samuel was a constable in the "second hundred" in Nelson County, from
27 Feb. 1832 until at least 1846. (Constable's bonds recorded in Nelson
County Will Book D:162; WBD:186; WB D:305; WB E:278; WB F:38;
WB F:322; WB G:32.)
!Samuel was appointed administrator of the Virginia estate of his father,
Dr. Samuel Gay, in 1857 (administrator's bond, Nelson Co. WB J:374).
This was apparently done in connection with the dispute regarding his
father's estate (see notes under Samuel Gay).
!Samuel Gay does not appear on the land tax lists for Nelson County,
from 1809 to at least 1818. (Library of Virginia, land tax records,
reel #205.)
!Additional children of Samuel Gay Jr. are listed on another researcher's
Web site at http://familytreemaker.genealogy.com/users/d/u/n/James-R-
Dunavan/index.html, but no sources are identified for those additional children.
