The said Prisoner was led to the bar in custody of the Jailor and
thereof being arraigned pleaded Not Guilty by him and thereupon the
Witness to wit Zachariah McDaniel being sworn and examined (illegible)
the said offense, and the said prisoner being fully heard in his defense
by David Irvin esq., his attorney, the Court upon consideration thereof
are of the opinion that the said prisoner is Guilty of the offense whereof
he stands charged, whereupon it is ordered that he be forthwith burnt
in the hand by the Jailor of the Court, and that he moreover receive on
his bare back at the public whipping post 30 Lashes, and it is further
ordered that the Sheriff cause this last part of this Judgment to be
immediately today inflicted on the said Prisoner, after which he is to be
restored to the Jailor to be kept as a runaway slave.

DATE/PLACE: Certified Copy of Record of Death; Clerk's Office;
Rockingham County, Virginia (gives age at death as 99, and says that the
informant, an unnamed dau., "didn't know" his parents' names). Also
contained in Rockingham County, Virginia Deaths, 1886-1895;
on-line database at http://www.ancestry.com). Also reflected in
Rockingham County, Virginia, Will Book 4; Page 32.
FATHER: The following facts indicate that my Zachariah was a son of
one John McDaniel or McDanold of Rockingham County:
(1) The 1810 census of Rockingham County (where Zachariah was
born) includes only one person whose surname begins "McD" or "MacD":
Elizabeth McDanold (page 147), with two males under 10, one male
age 10-15, one female under 10, one female age 10-15, one female
age 45+. My Zachariah would have turned 16 in 1810, so the male
age 10-15 appears to be him. (The immediately preceding household
is that of Martin Crawford, and the next Zachariah Crawford. The list
is not in alphabetical order. See notes under Elizabeth Crawford and
John McDaniel for evidence re: their marriage and her maiden name.)
(2) In the 1820 census of Rockingham County, the household of
Zacariah McDaniel is listed immediately before the household of
Elizabeth McDaniel (page 150). My Zachariah married in 1818. In the
1820 census, all of the "M" surnames are listed together, but the list is
not alphabetical within each letter of the alphabet. The next-closest
McDaniel household is ten lines away.
(3) Three other McDaniel households are included in the 1820
census of Rockingham County: those of William McDaniel (page 178),
Armstead McDaniel (page 151), and Derenzoy McDaniel (page 150).
- William McDaniel was married in 1818 (according to an abstract of
the marriage bond on the RootsWeb site for Rockingham County).
Additionally, William's wife in the 1820 census was only 16-26 years of
age, which is too young to have borne Zachariah.
- Armstead McDaniel's age in the 1820 census is 26-45, but he has
only two children, and both of them are under age 10 -- suggesting
that he is in the lower end of the 26-45 range, and thus too young
to be Zachariah's father.
- Derenzey McDaniel was married in Orange County, Virginia, in 1793
(Orange County Marriages, 1747-1850, by John Vogt and T. William
Kethley, Jr., page 83), whereas my Zachariah was born in Rockingham
County only a year after this marriage in Orange County; also, Derenzy
McDaniel was witness on the marriage bond of Jeremiah McDaniel in
Orange County in 1799 (same source), further solidifying Derenzy's
connection to Orange County around the time of Zachariah's birth in
Rockingham. (I cannot find Derenzey in the 1810 census, except
that there is a Durenza McDaniel in the 1810 census of Rockingham
County, North Carolina, page 12.)
(4) John McDaniel had a brother-in-law named Zachariah, after whom
my Zachariah McDaniel was apparently named (see notes under John
McDaniel).
Apparently someone attempted to kill Zachariah; the following
transcription is from another researcher:
ROCKINGHAM COUNTY COURT MINUTE BOOK #13, PAGE 107
"At a Court ---- held at the Courthouse of Rockingham county on the
9th day of December 1830 for the trial of Giles a Negro man slave the
property of Frances Wilkerson of the County of Buckingham, who was
committed to the Jail of this County on Suspicion of felony and stands
charged with feloniously, voluntarily, maliciously, and of purpose
stabbing Zachariah McDaniel with the intent in so doing to maim,
disfigure, disable, and kill him the said McDaniel -
