Individual:
!Birth date is based entirely on the assumption that she was born
about 22 years before her first-born child.
!Some researchers state that Elizabeth's maiden name was BAKER,
and that her father was one Bartholomew Baker. This is based on
(1) a litigation file from Hopkins County, Kentucky (Circuit Court Case
#1533), a transcription of which is posted at
http://sunimaze.home.att.net/baker_vs_baker.htm, and (2) two items
in the reports of the American Loyalist Claims Commission, stating that
Bartholomew Baker of Orange County, Virginia, "remov'd to one of
the Southern States ... before the war," and that "[f]or some time
before his removal he was supported by his Sons in law Benjamin and
Jonathan Martin of Orange" (British Public Records Office, series T79,
piece 91, page 101, and piece 95, page 87; transcribed in The Virginia
Genealogist, vol. 28, page 54, and vol. 32, page 269). The complaint
in the cited litigation file, dated June 4, 1829, refers to "Charles Martin
Molly Martin, Benjamin Martin, Clarissa Martin and Susannah Martin who
are the children of Elizabeth Martin decd Who was a sister of the said
Richard Baker decd". The following considerations would tend to
support a conclusion that the Elizabeth BAKER MARTIN mentioned in
this complaint is my Elizabeth, wife of John Martin of Albemarle County:
(1) My Elizabeth, like the Elizabeth of the complaint, had children
Benjamin, Mary, Susanna, and Clarissa -- a very strong coincidence.
(2) The complaint states that Elizabeth BAKER MARTIN had a
nephew with the first name Linsey, and my Elizabeth's son, Benjamin,
named a son Lindsay.
The following different considerations would tend to refute a
conclusion that the Elizabeth BAKER MARTIN of the complaint is my
Elizabeth:
(1) The list of Elizabeth BAKER MARTIN's children omits Sally,
daughter of my John Martin, and it adds a son Charles who is not
mentioned in the will of my John Martin. On the other hand, the
complaint gives no married names for any of the many adult females
mentioned, so apparently the plaintiff was not extremely familiar with
the extended family.
(2) The 1830 census of Kentucky includes two Benjamin Martins
in Warren County (pages 90, 99), a few counties away from Hopkins
County, either of whom could be the Benjamin Martin mentioned in
this complaint; whereas my Benjamin Martin, son of my John and
Elizabeth Martin, died in Virginia.
