John Vogt & T. William Kethley; vol. I; page 206 (gives bride's
name as Caty Bailey). Her name is given as Catherine in a
lawsuit involving Benjamin's estate (Albemarle County Chancery
Cause 1829-007; Box 31; Library of Virginia). Birth date is based
entirely on the assumption that he married at about 26 years of
age.
!PARENTS: Will of John Martin; Albemarle County, Virginia; Will
Book 5; page 200. That the son Benjamin in this will is my
Benjamin Martin is shown by the following facts:
(1) The will also mentions grandchildren John Martin, Benjamin
Martin, Lindsay Martin, and Elizabeth Martin; and my Benjamin
Martin had children by those names.
(2) The will mentions no son, other than Benjamin, who could
have passed the surname MARTIN to those grandchildren.
(3) The marriage of Lindsay Martin (son of Benjamin) is the only
Lindsay Martin marriage in Albemarle County Marriages, 1780-1853;
by John Vogt & T. William Kethley, Jr.

widow, Catharine Martin, and all of his children except James).

County (Virginia) Order Book 1808-1810, at page 55 (as
transcribed in ibid., page 163):
"The Commonwealth of Virginia against Benjamin Martin Overseer
of the road from William Woods to Simpsons ---
"Upon a presentment of the grand Jury for not Keeping said road
in good repair.
"This day Came as Well as the attorney for the Commonwealth And
it appearing to the Court that the Defendant Duly Summoned and
not appearing Therefore it is Considered by the Court that the
Commonwealth recover against him fifteen shillings the penalty
imposed by law on Overseers of the road and the Costs of this
Prosecution."
!The following entry, dated Sep. 3, 1811, appears in Albemarle
County (Virginia) Order Book 1811-1813, at page 42 (as
transcribed in ibid., page 192):
"Benjamin Martin is appointed Overseer of the road from Woods
shop to the forks of the road leading to James Olds mill with the
gang as P list to keep the same in good repair"
!The following entry, dated Mar. 2, 1812, appears in Albemarle
County (Virginia) Order Book 1811-1813, at page 137 (as
transcribed in ibid., page 199):
"The Commonwealth of Virginia against The Surveyor of road from
Woods Shop to forks road leading to Olds
"Upon a present.
"Benjamin Martin being herd it is ordered that this presentment be
dismissed"
!An estate division of one Benjamin Martin was recorded on
October 1, 1849 (Albemarle County, Virginia; Will Book 19;
page 277). This is apparently the estate of this Benjamin Martin --
perhaps divided after the conclusion of the litigation cited above --
because (1) the division mentions one Joshua W. Abell as receiving
property from the estate, (2) this Benjamin Martin had a daughter
(Caroline) who married Joshua W. Abell (see notes under Caroline).
