Record of Solomon Collins will & the Probate thereof.

Last will and testament of Solomon Collins. I Solomon Collins of the town of Brookfield in the county of Madison and State of New York, being weak of body, but of sound mind and Judgment, do make and ordain this my last will and testament in manner and form following that is to say. I give to my wife Anna the use of all my property and effects until my son Solomon B. Collins becomes of age for the use and support of herself and children, and when my son Solomon B. Collins becomes of age, I give to him one third of all my property, and I give to my four daughters (vis) Maryan, Elisa, Mariah and Ruth Oliva one third of all my property to be divided equally between them, when they become of age, and I give to my wife one third of all my property as long as she lives and after her death to be equally divided between my five children (vis) Solomon B. Collins, Maryan Collins, Elisa Collins, Maria Collins and Ruth Oliva Collins. I hereby make appoint and constitute Hesekiah Collins of the town of Brookfield county of Madison and State of New York, and James K. Larkin of the town, county and State aforesaid Executors of this my last will and testament, to lay out my property in a farm for the use of my wife and children until my children become of age, and then when my children become of age to divide and pay to each of them their several shares according to this my last will and testament. State of New York, Madison County Be it remembered that at a Surrogate Court held for the county of Madison, at the Surrogates Office in Morrisville on the 16' day of June 1835 & continued & adjourned from that day to the 23' day of June in the same year, before Otis P. Granger Surrogate of said county, the last will & testament of Solomon Collins late of Brookfield in said county deceased (of which the foregoing is a copy) on the day & year last aforesaid, was admitted to Probate after a citation to the widow & next of kin to the said deceased Signed, served, returned & filed according to law.

Whereupon on the said twenty third day of June in the year & at the place aforesaid Mather B. Church of Brookfield, one of the subscribing witnesses to the said will, after having been duly sworn by me the said Surrogate testified, that he was well acquainted with the said Solomon Collins deceased in his life time that he the said Mather B. Church, by the direction of the said deceased, signed the name of him the said Solomon Collins, to the instrument shewn unto him, which said instrument purported to be the last will & testament of the said deceased date the 23' day of May 1835, that he heard him the said deceased publish & declare the same to be his last will & testament, that at the time thereof he the said Solomon Collins deceased, was of sound, disposing mind & memory, of full age & not under any retraint & that he the said Mather B. Church, together with Emma Larkin & Lydia Coon the other subscribing witnesses to the said will, did personally subscribe their names as autographs thereto in the presence of the said testator & of each other & at the request of the said testator. And the said Mather B. Church further testified, that he retained said will in his possession from the time of its execution as aforesaid, until he delivered the same to the said Surrogate for Probate. Whereupon I the said Surrogate upon the proof aforesaid being satisfied of the genuineness & validity of the said will, order that the same be admitted to Probate & that letters testamentary thereof be granted to the Executors the said will names after the expiration of thirty days from the hour of taking the Proof aforesaid. Witness my hand & seal of Office this 23' day of June 1835.
