William and Allen Elliott Executors (Per Amos A. Elliott, Bknv1@aol.com email dated 9/29/0 2 - Amos A. Elliott Jr. has a certified bopy of the complete Will and Testament. He also has a copy of the document in which the Executors, WILLIAM and Allen ELLIOTT resigned their executorship filed for record on 26 Nov 1842, State of Alabama, Shelby County, Charles r. Gibbs, Judge of the county Court presiding. The same document bonded Nancy Elliott as the executrix signed by Nancy Elliott witnessed by Elisha Nelson, Green Elliott, Amos Merrell, Sarah Elliott and Allen Elliott. )
In the name of God Amen, I Amos Elliott of the State and County above being
greatly afflicted but of sound and disposing mind memory and understanding do
make this my Last Will and Testament in the following manner.
First; My will and deserve is that my just debts and funeral expenses be paid.
Next my will is that my wife Nancy (Hale) Elliott retain all my property
possessions during her life. Viz. All my plantation tools, horse, hogs,
cattle and sheep, also my negros, namely Bob, Adenon, Jade, Jenny, Wat, Bias,
Marrian, Joe. Except it become necessary to sell Bob to pay my debts. In that
case my executors be at liberty to do so. Also my plantation and lands. Viz.
SW quarter of the SW quater of section 22 in township 20 of range one east in
the district of lands subject to sell at Tuscaloosa and west half SE quarter of
section 22 township 20 range one east of east half of SW quarter of section 22
of township 20 range one east and east half of the east half of the NW quarter
of section 27 in township 20 of range one east and west half of the NE quarter
of section 27 in township 20 of range one east and SE quarter of SW quarter and
NE quarter of SE quarter all in the district of lands subject to sell at
Tuscaloosa. Then my desire is that at the death of my wife all my lands be
equally divided between my five youngest sons namely,

Elliott) and the balance of my property, that is my negros, plantation and
stock as above mentioned be equally dived among all my children namely Willis
Elliott (129) William(131) , Allen Elliott (574), Jenny (Jane Elliott Rogers)(575) Polly Hane y (576)
and the share of my two sons that are dead Amost elliott (572) and Charles Elliott (573) g o to their
children Parrallee Elliott, Nancy Elliott, Sara Ann Elliott and Elizabeth
Merrell and Mahala Clower and the five youngest sons above named. Lastly I
constitute, nominate, and appoint William Elliott and Allen Elliott executors
of this my Last Will and Testament in witness whereof I have unto set my hadn
and seal this day and date above.

This day came into court John W. Teague who being dually sworn says that he
with named Amos elliott did make publish and declare the within instrument as
his Last Will and Testament and subscribed the same in my presence and in the
presence of all the subscribing witnesses and that the subscribing witnesses
signed their name in the presence of the cutator and of each other on the day
therein mentioned sworn to the subscribed to in open court this 4th day of Nov.

Birth is located in North Carolina - discrepency with my notes.
Alternate Birthdate is 27 Aug 1766 Rowan Co North Carolina.
She identifies parents as William Elliott (b: bef 1740 and Jean/Jane UNKNOWN)
but states, there is no documentation that Amos Elliott was the son of William
Elliott and Jean/Jane. I have put him in this family based on the migration,
marriage and naming trends in the families of Amos and Nancy Elliott Merrill.

He was born in North Carolina, probably Anson County. He was in Edgefield District, SC in 179 0 with a wife and two sons, Willis and William, who were born in SC. Two daughters and youngest son Allen were born in TN. They came to AL in 1809 to Madison County where the wife (name unknown) died. Later Amos remarried Nancy Hale and they had 10 or 11 children, one of those listed might have been a grandchild.
Amos had a sister Nancy, born in Rowan County, NC in 1772 and she married into the Merrill fa mily in Rowen County. The Merrills came to AL at about the same time as the Elliotts.
