None of thelegatees was called a relative. The will was provedthe same year, but for some reason the lands were notdistributed until an order of the Court was obtained, 2 Jan1728/19, to divide them, according to the will, between: JohnBayley; the heirs of Lydia Spencer, deceased; Elizabeth Clark;Benjamin Bayley; the heirs of Susannah Hubbard; NathanielBayley; and Mary Cornwall; "Children of Lydia Bayley Deceased."[Manwaring's Digest, 1:234.]The will of John Bailey, Sr., of Haddam, dated 17 Jun 1696(inventory taken 29 Aug 1696), mentions eldest son John; sonsBenjamin and Nathaniel; daughter Lydia; daughters Susannah andMary (unmarried); on the other side of the paper, datedHaddam 3 Jul 1696, is mention of daughter Elizabeth Clark's sonThomas Clark [Ibid., 1:535].Nathaniel Spencer's wife was Lydia Bailey (who was not wife toThomas Smith, as some sources record), daughter of John andLydia (Backus) Bailey, and granddaughter of William Backus byhis unknown first wife.
