BEE IT KNOWN that I, John Faierbancks of Dedham do makethis my last will and Testament in manner and forme following,being sound in my understanding and of a disposing minde, Forwhich I bless God, and knowing the uncertainty of this life, andbeing by many awfull intimations minded of my great change,shall therefore, God assisting me, endeavour to set my house in order. And FirstI comit, bequeath and resigne my Soule unto the hands ofAlmighty God, my Creator, being hopefully assured, believingthat I shall receive the full pardon and free remission of allmy Sins and be saved by the precious Death and merits of JesusChrist, my Redeemer, and my body to the earth from whence it wastaken, to be Decently and in Christian manner interred after myDecease, by my Executor and Overseers or Supervisors hereaftermentioned, and after my debts and funerall charges be paid, mymind and will as touching such worldly things over which theLord have me steward, is that they be empowered asfolloweth,--viz. IMPRIMIS. I give and bequeath to my eldest son John Fairbanksall my rights within the Town of Wrentham, conteining thirteenCow commons with some Sheep commons, with all that do or shallbelong of right to them in any manner or kind whatsoever withinthe Town of Wrentham or adjoyning to that Township, to wit, myrights in that last Indian purchase bought of Philip Sagamore,all which I value at Forty pounds. More I give and bequeath tomy eldest son John Fairbanks ten pounds which is to beunderstood because he is my eldest Son, and therefore my mindand will is that he John Fairbanks shall receive of my Estateor from my Executor ten pounds more than either JosephFairbancks, my second son, or Benjamin ffairbancks, my youngestSon: And further my minde and will is that after my debts andLegacies and other charges be paid, that my son John Fairbanksshall receive of my Sons Joseph and Benjamin Fairbanks incurrant Country payment to make up that Fourty pounds by megiven in Wrentham equal with my other two Sons, namely Joseph ?Benjamin Fairbanks, and my mind and will is that Joseph andBenjamin ffairbanks shall pay or cause to be paid to my Son JohnFairbanks or his heires in Dedham ten pounds in currant Countrypayment pr yeare beging the next yeare after my decease and soto continue forth on in ye insuing yeares to pay untill he sdJohn Fairbanks shall have received both his ten pounds aboveexpressed, and to make him equall with his Bretheren as above isexpressed, and alike my mind is that if my Sons Joseph ?Benjamin ffairbanke can pay their Brother John ffairbanke morethan ten pounds pr yeare they shall do well, but my mind inexpressing ten pounds pr yeare is that they shall not be drivento more. Item. I give and bequeath to my daughter Hannah ffaierbanksSixty pounds, and my mind and will is that she shall have herfirst choice in the movables of the house to the value of twentypounds, and then she my said daughter to receive ffourty poundsmore of her Brothers (to wit) Joseph and Benjamin ffairbankswithin the space of Six yeares after the day of my decease incurrant Country payment, my mind is that my daughter HannahFairbank do receive Six pounds thirteen Shilling four pence pryeare in the yeares as above expressed, to be paid by Joseph andBenjamin Fairbanks. Item. I give and bequeath to my grand daughter Mary Sawyer theSum of ffifteen pounds to be paid by my Sons Joseph and BenjaminFairbanks in currant Country payment, and my mind is that She mysd Grand child shall receive the first ffive pounds when sheshall attain to the age of one ? twenty yeares, and so forth onin the next ensuing years five pounds pr yeare untill she havereceived her ffifteen pounds. And if She my sd Grand Child shalldye before she attain to the age of twenty and one years thenthis ffifteen pounds to return to my Children surviving to beequally divided. It. I give and bequeath unto Joseph Fairbanks my second Son andunto Benjamin Fairbanks my youngest Son all my houses barnsOrchards Lands meadows common rights goods movables cattelldebts and whatsoever is not already given and legally disposedof, they paying all debts ? Legacies and charges whatsoever, tobe in all honest respects divided equally betwixt them my SonsJoseph and Benjamin Fairbanks. And forasmuch as my Son JosephFairbanks have already received one of my dwelling houses andLand to it notwithstanding if he shall see fit to choose thehouse of which I am now possest of and shall resigne that situation that he is possestof by a deed of gift from me his Father to my Son Benjamin uponequall terms as he shall receive the other house, then my mindis that he have his choice of the houses, and that the whole ofmy remaining Estate be divided betwixt them sd Joseph andBenjamin Fairbanks as above sd. It. I do hereby make ordein and constitute my loveing Son JosephFairbanks my sole Executor to do and performe this my last willin all the parts thereof above expressed: I do also desire andchoose my trusty and well beloved friends Thomas Medcalfe andJames Thorpe Senior my Overseers or Supervisors to assist myExecutor by joyning with him to help by counsell and advice thatall might be carried on peaceably, and I do hereby declare thatmy mind is that my Executor and my other Children be ready to beadvised by my Overseers.
