He married (1) ANNIE BUFFINGTON (Source: Emmet Starr, Grant 1-1-1-6.), daughter of EZEKIAL BUFFINGTON and MARY EMORY. She was born Abt. 1792, and died (Source: no issue.). He married (2) MARY BUFFINGTON (Source: Emmet Starr, Grant 1-1-1-8.), daughter of EZEKIAL BUFFINGTON and MARY EMORY. She was born Abt. 1798, and died Aft. 1851.

In the compilation for the family of James Daniel (Grant 1-1-1-8) Hampton & Baker have an additional child inserted as Peter Daniel 1-1-1-8-4x with the notation "48 d 54" which I take to mean born in 1848 and died in 1854; however, in the list of names of Cherokee emigrants under the Treaty of 1835, dated April 1838, there is an entry A415 for Widow and heirs of Ja's Daniel (Long Swamp, GA) for the amount of $5,270. The notation reads "The name of the widow is Mary Daniel, the names of the heirs as far as are certained are Betsy, now W' Sam'l K Ware [Susan Daniel], James Daniel, Martha Daniel and Ezekiel Daniel. It is supposed there are some others, perhaps two [unreadable part]". This entry indicates that James died before April 1838 and could not be the parent of a Peter born in 1848.

One half breed, 10 1/4 bloods, one ?, Four farms and 3 farmers. 6 readers of English, Four weavers, four spinners. This family owned 37 slaves.
In the weeks and months after the roundup and before the removal began, Chief Ross negotiated to have Cherokee "Conductors" lead each group of "immigrants" so as to better ensure their welfare. There were thirteen groups in all and included, as a Conductor, was Moses Daniel, son of Marmaduke and brother to James, who had died the year previously. The level of suffering and despair was described as horrible and deplorable. Over 4000 Cherokees, many of them women and children, died during the march because of cold weather, exhaustion, and exposure. Special difficulty was encountered by the detachments conducted by Peter Hildebrand, Richard Taylor, Moses Daniel, James Brown, and Elijah Hicks, which were stranded between the icy Ohio and Mississippi rivers in late December. Lewis Ross, brother of John Ross, made a special purchase of warm clothing for the emigrants in St Louis.
