NOTE: In the Caroline Cty Order Book, 1740-1746, page 349 there is an entry which links this Edward Ware to Nicholas Ware, Jr.. Copy of this document is on hand. It is copied below. ====== 349 The Last will and Testament of Nicholas Ware, deceased, was presented in Court by a Nicholas Ware and others (unreadible) therein named who made oath thereto According to Law and being further proved by the oaths of John Dillard, Benjamin Harrison, and Nathan Hall, witnesses thereto and ordered to be Recorded and John Dillard, the writer of the will of Nicholas Ware, made oath that the Intention of the Testator was to Leave the Negro woman he had lent to his wife during her widowhood to his son Edward During his life and also the other two negroes Ben and Sarah. ====== --------------------//--------------- This tie between Edward Ware and Nicholas Ware, who was an Attorney at Law, is evidenced by the following entries: Caroline County, VA Order Book, 1732-1740 Page 631 [8 August 1740] On petition of Edward Ware, it is considered that he have a license to keep an ordinary at his house. He had Nicholas Ware, Jr. as his security as acknowledged in his bond. Caroline County, VA Order Book, 1740-1746. Page 63 [14 Aug 1741] Edward Ware's license for keeping an ordinary is renewed. Nicholas Ware is his security. Page 126 [13 Aug 1742] Edward Ware's license is extended one more year. In "Colonial Caroline, A History of Caroline County, Virginia" by T.E. Campbell, The Dietz Press Incorporated, Richmond ,VA on page 411 indicates that Edward Ware maintained his tavern from 1740-1744 near Conway's warehouse. The same page indicates that from 1744-1748 Josiah Baker held the license. -------------------//--------------- The following entry shows some tie between Edward Ware and the Powell Family. It come from the Caroline County Order Book, 1746-1754, Page 465, 15 Mar 1754. ===== The Last Will and Testament of Mary Powell was presented in Court by Edward Ware and Millicent Powell, executors therein named and proved by John Regan, who swore he saw Catherine Regan and Morning Barsdale witness the same. See T.E. Campbell, "Colonial Caroline", (Richmond: 1954), p. 474. ===== ------------------//--------------- It is believed that this is the Edware Ware who served in the French and Indian Wars from "Old Albemarle" in 1755. (Affidavit of Alexander Brown, Esq. See VA Genealogy, Hayden, page 40. ===== The will of Edward Ware is recored in Will Book 3, page 9, 10, 11, & 12 maintained the the Amherst County Circuit Court Clerk's Office, Amherst, VA. The will was probated on 3 July 1786. The inventory of the Estate of Edward Ware is recorded on page 19-20, Will Book 3, Amherst County, VA. 2 Oct 1786. LAST WILL AND TESTAMENT OF EDWARD WARE In the Name of God, Amen. I, Edward Ware of Amherst County and the Parish of Lexington, being very sick and Weak of Body, but in perfect mind and memory thanks be to God the Same, Calling to mind the Mortality of my Body and knowing that it is appointed for all men once to dye, I do make and Ordain this my Last Will and Testament, that is for to Say principally and first of all I give & Recommend my Soul to Almighty God that gave it, and my Body to the Earth to be Burried in a Christian like manner at the Desetion of my Executors nothing Doubting but al the General Resurrection I shall Receive the same agin by the powers of Almighty God, and Touching Such worldly Estate that has pleased God for to Bless me with in this Life I give & Devise and Dispose of the same in the following Like manner & form. I Give unto Mark Ware five Shilling Sterling and the Each of Mark Ware Children five Shillings Sterling; Item I give James Powell four hundred Acres of Land whereon he now Live and Negro Toby forever; Item I give William Powell Two hundred and fourteen Acres whereon he now Live & Negro Gloucestor forever; Item I give John Powell four hundred Acres of Land he now lives on and Negro Jeffrey forever, one hundred pounds; Item I give Edward Powell Two hundred Acres of Land I now live on and a Survey Joynit and three hundred and fifty one Acres over Pedlar on the Rich Mountain and Negro Dinah, one feather Bed and furniture, one horse, saddle and Bridle, one cow and calf forever; Item I give Elizabeth Joplin Two hundred acres of land Joyning W. Higginbotham and Negro Franke and her Increase forever, one feather bed, etc.; Item I give Anne Campbell half of that tract of (Land) Joyning W. Gordon and Negro Agg and her Increase forever; Item I give Sarah Ware half of that tract of Land Joyning W. Gordon and Negro Doll and her Increase forever and one Horse and Side Saddle, one cow and calf, one Feather Bed and furniture; Item I Lend my Beloved wife Lettis Ware all my Estate that I have not Disposed During her Natural Life or Widowhood and then for to be Equally Divided Between James Powell, William Powell, John Powell, Edmund Powell, Elizabeth Jopling, Anne Campbell, and Sarah Ware, I also Constitute, make, and Ordain James Powell, William Powell, John Powell, Edward Powell Sole Executors of this my Last Will and Testament and I do hereby utterly Disalow, Revoke & Disanul all and every other former Will and Testament, Legacies bequeaths and Executon by me in any Wife before named Willed & Bequeast. Ratified and Confirmed this and no other for to be my Last Will and Testament. Culloch, Witnesses thereto, whereupon the said Executors with Thomas Lucas and John Crawford, their Securetys Entered into and Acknowledges their Bond in the Penalty of five Thousand pounds and took the oath Required by Law and this will was Ordered to be Recorded. WM LOVING, Clerk ================================================================= ==== Based upon the above will, the children who are offsprings to this marraige are: Sons: Mark, James, William, John, and Edward; Daughters: Elizabeth, Anne, and Sarah. Nicholas Ware IV and Robert Ware, Captain are listed under Nicholas Ware III. According to Wilder-Ware Familes they are brothers to James and Edward Ware from this family. This is one area that needs additional research. QUESTION: Why did Mark Ware and his children receive only 5 shillings when all of his sisters and brothers were given parcels of land? One possibilty is, as suggested on page 850 of the Wilder Ware Families, that he had previously received some land in KY. Several members of the Ware families did move to KY in this period of time. ================================================================= The U.S Census, 1783 Amherst Cty, VA shows: HEAD OF FAMILY WHITE BLACK WARE, Edward 3 15 WARE, William 5 4 WARE, Mark 9 -- THURMOND, Philip 9 13 VEALE, William 5 -- =========================================================== See also notes under his wife Lettis Powell. QUESTON: Were the children refered to as "Powell" in the will the step children of Edward Ware? The notsd filed under his wife, Lettis, indicate there may have been children born out of wedlock. One thing for certain Edward Ware did recognize the children and left considerable property to them. =========================================================== According to John H. Smallwood the date of birth of Edward Ware was abt 1710. This date was selected because of the dates on his will which is recorded in general notes for Edward Ware. Will was signed on 1 Jun 1799 and was probated the the Amherst Probate Counrt on 3 Jul 1786. Therefore death is between these dates.
