BIOGRAPHY: He was apprenticed to neighbor Merco MacKinna and listed with him as tithable in 1
682 (as Ja Bineham) and 1683 (as Ja Bnyeham). In both cases they were listed consecutively with his father and brother "Jno Byneham Senr & Junr". He was listed with George Morrell in 1684, with George Blow Jr. in 1685, alone in 1686, with Richard Smith in 1687, and alone from 1688 onward. He and brother John were also listed in the Surry militia in the muster of 1687.

BIOGRAPHY: James Bynum's first recorded land purchase was dated 5 Jan 1691, from Luke and Eli zabeth Mizell. He was a grand juror for the year beginning September 1693, and was one of the appraisers of the estate of Luke Mizell on 1 May 1694. He purchased land from Edward Newby between the Blackwater and Johnchecohunk Swamps on 29 Apr 1698, and was granted 250 acres south of the Blackwater in 1699. He was again a grand juror in 1700. On 2 Oct 1703 Luke Mizell 'of North Carolina' (the son of the above Luke Mizell and possibly James' brother-in-law) conveyed to him a parcel of land in Surry County. The 1704 Virginia Quit Rent roll shows James with 157 acres. This holding was sold by James and his wife Elizabeth to Thomas Farrell on 2 July 1706, when it was described as consisting of 150 acres purchased from Newby and 7 acres purchased from Mizell.

BIOGRAPHY: About 1713 he arranged to acquire land from George Nicholson whose will dated tha t year directed his heirs to confirm a sale to James Bynum of land located between the Nottoway and Meherrin Rivers (probably in what later became Southampton County). In 1714 James was granted 330 and 140 acre parcels south of the Blackwater. He was also granted 100 acres in Isle of Wight County on 11 Apr 1719.

BIOGRAPHY: James Bynum died sometime between 1719 and 1724 since on 21 Apr 1724 "William Bina m of ...North Carilinah" sold to Joseph Franco the 100 acres in Isle of Wight which had been granted in 1719 to "James Binam decet". James may have
died earlier, since the same William Bynum had on 16 September 1723 sold 460 acres on the Bla ckwater which match the description of the lands granted James Bynum in 1714.

BIOGRAPHY: No further record of James Bynum was found, thus we have no clear record of the di sposition of his estate or of his beirs.

BIOGRAPHY: Elizabeth, wife of James Bynum, is thought to be a Mizell, daughter of Luke. Othe r than in deeds, there are no direct references to their children. However, it is clear that they had sons named John and William, and we have attributed a third son, James, based on the name as well as his later association with James' son William.

James Bynum was probably born in 1665 or 1666. His father appeared in all the Surry tithable s lists from
1668, but James appears for the first time in 1682. Since the tithables were taken in June , this means
James turned 16 between June1681 and June1682. As the younger son he was apparently apprenti ced to a
neighbor named Merco MacKinna; he was listed with MacKinna in the tithables lists of 1682 an d 1683. In
both cases, they were listed consecutively with his father and brother. In 1684, he was list ed with George
Morrell, in 1685 with George Blow Jr., by himself in 1686, and with Richard Smith in 1687. I n 1688 and
thereafter, he was listed by himself. He was also listed with his brother John in the Surr y militia muster of
1687[1].

James BynumâÇôs first recorded land purchase was 5 January 1691, from Luke and Elizabeth Mizel l to âÇúJames
Bynham, planterâÇù[2]. The acreage was unspecified. He began appearing in the Surry court r ecords shortly
thereafter, appearing as a grand juror in September 1693[3] and as one of the appraisers of t he estate of
Luke Mizell on 1 May 1694[4]. He purchased additional land from Edward Newby on 29 April 16 98[5] and
was granted 250 acres south of the Blackwater in 1699[6] He again served on a grand jury i n 1700[7].
He also appears a few times as a witness.

On 2 October 1703, Luke Mizell (the son of Luke Mizell and possibly James BynumâÇôs brother-in- law) sold
him 100 acres of land in Surry County when Mizell moved to North Carolina [8] . Althoug h I found no
record of any land sales by James Bynum up to this time, the 1704 Quit Rent roll shows him wi th only 157
acres. This land was sold by James and his wife Elizabeth on 2 July 1706, when it was descri bed as 150
acres originally belonging to Luke Mizell and 7 acres purchased from Newby [9] . I might not e that not all
land was subject to the quit rents.

James Bynum next appears as security for an orphans estate in the hands of James Turner on 2 5 November
1711 [10], and as a successful plaintiff in a debt case against Edward Long on 18 February 17 12 [11] .
Although he was clearly living in Surry County, it is not clear what land he was occupying . About 1713 he
arranged to acquire land from George Nicholson. NicholsonâÇôs will, dated that year, directe d his heirs to
confirm a sale to James Bynum of land between the Nottoway and Meherrin Rivers (probably in w hat later
became Southampton County). In 1714, he was granted 330 and 140 acre parcels south of the Bl ackwater
[12] which were probably contiguous. Finally, he was granted 100 acres on Flatt Swamp in nei ghboring
Isle of Wight County on 11 April 1719 [13] .

James Bynum evidently died about 1723, as his next citation is posthumous. On 21 April 1724 , âÇúWilliam
Binam ofâǦNorth CarilinahâÇù sold to Joseph Franco the 100 acres in Isle of Wight which had bee n granted to
âÇúJames Binam decet.âÇù [14] The same William Bynum had, several months earlier on 16 Septembe r 1723,
sold 460 acres on the Blackwater which match the description of James BynumâÇôs 1714 land grant s. No
record of his estate was found.

Unfortunately, there are no Surry court orders for the period 1718-1741. James BynumâÇôs estat e records
would have been among these missing records. SurryâÇôs wills do exist for the period, but ther e is no will
recorded for James Bynum. Since there are no records of his children, we are forced into spe culation.
Surry records, and later records from other counties, make it clear that James Bynum and hi s brother John
each had sons named William and John. There is a considerable amount of circumstantial evide nce (see the
book) that one of these John-William pairs belonged to John Bynum, thus the other two must b e sons of
James Bynum. I might note that all these Bynums of Surry County used distinctive marks as th eir
signatures, making it fairly easy to tell them apart, at least in the Surry records and som e North Carolina
records. I believe the next-generation James Bynum is probably the son of James as well, an d his
distinctive mark was used both in Surry and in North Carolina as his signature. In addition , all three of the
sons below migrated to the same area of Edgecombe County, North Carolina.

Elizabeth, the wife of James Bynum, may have been the daughter of Luke Mizzell, but there i s insufficient
proof. (See MIZZELL paper)

1.William Bynum (c1690 âÇô 1746) He appears to be the eldest son, based on his evidently in heriting
James BynumâÇôs lands. See below.

2.James Bynum (1690s âÇô 1763) He used a very distinctive mark in both Virginia and North C arolina,
making it easy to trace him. He was not associated with either of the children of Joh n Bynum, only
with the children of James. He married Agnes Nicholson Farmer, the daughter of George N icholson
and forty-ish widow of Thomas Farmer, before 1727 when she began styling herself âÇúAgne s BynumâÇù
partway through administering her late husbandâÇôs estate. James and Agnes Bynum witnesse d a will as
husband and wife about that time as well. They were not married in the eyes of the auth orities,
however, who fined Agnes in 1727 for having a bastard child, and both James and Agnes fo r âÇúevil
cohabitation togetherâÇù in 1728. That probably means they were married as Quakers. Jame s Bynum,
apparently with the Farmer children in tow, moved into North Carolina about 1730, livin g a few miles
from his brother William Bynum. He was âÇúof Edgecombe CountyâÇù on 8 January 1733 when h e bought
land from Thomas Turner on Kehukee Swamp. James aquired land on Deep Creek in 1742 an d lived
the rest of his life there. The area eventually became Halifax County. He died testat e in Halifax
County in mid-1763, leaving two sons and two daughters mentioned in his will: William B ynum,
Nicholson Bynum, Mony Dill (or Diel), and Agnes Whitney [15] . He may have had a son na med John
who died in 1761 and whose estate was administered by William and Nicholson âÇô itâÇôs not c lear
whether this John was his brother or son. He may also have had a son named Robert, wh o appears
briefly in the Edgecombe records in the 1750s but not thereafter. The children lived ma inly in Halifax
and Pitt Counties. Some of JamesâÇô grandchildren ended up in Georgia.

3.John Bynum (c1700 âÇô c1761?) He seems to be the same John Bynum âÇúof Surry County, Virgin iaâÇù
who purchased land on the Meherron River in Bertie in 1740. He was alive in 1744 when h e
witnessed a deed in Northampton County. He may be the John Bynum who died in Edgecombe
County, NC in early 1761 apparently without heirs. Nicholas Bynum was his administrator , with
William Bynum his security.
