In the name of God Amen. I Daniel Hightower of the County and
State aforesaid being of advanced age but of sound and
disposing mind and knowing that I must shortly depart this life
deem it right and proper both as respects my family and myself
that I should make a disposition of the property with which a
kind providence has blessed me do therefore make this my last
Will and testament hereby evoking all others heretofore made by
me.
Item 1 I desire and direct that my body be buried in a decent
and Christian like manner.
Item 2 I desire and direct that all my just debts be paid by
my executor hereinafter appointed.
Item 3 I will and bequeath to Seaborn J. Hightower the son of
my first wife but not my son the sum of one dollar and no more.
Item 4 I will and bequeath to my Daughter, Nancy Saterwhite
the children she now has and those she may hereafter have by
her present or a future husband, free from the Debts control or
disposition of her present or future husband, nine hundred and
sixty five dollars over and above what she has already received
from me to be paid to her by my Executor hereinafter named and
at her death to her then living children, and I hereby appoint
Thomas A. Hightower and Leroy G. Hightower (my sons) Trustees
for my aid daughter, Nancy Saterwhite.
Item 5 I will and bequeath to my son Thomas A. Hightower one
thousand and sixty five dollars in money to be paid to him by
my Executor over and above what he has already received from
me.
Item 6 I will and bequeath to my son Robert T. Hightower
seventeen hundred dollars and sixty five dollars in money to be
paid to him by my Executor over and above what he has already
received from me.
Item 7 I will and bequeath to my son Leroy G. Hightower one
thousand and sixty five dollars in money to be paid to him by
my Executor over and above what he has already received from
me.
Item 8 I will and bequeath to my son James F. Hightower seven
hundred and sixty five dollars in money to be paid to him by my
executor over and above what he has already received from me.
Item 9 I will and bequeath to my daughter Naomi B. Butts wife
of Jepe G. Butts a negro girl by the name of Antonett yellow
complection nine or ten years of age now in possession of the
said Jepe G. Butts and the sum of one thousand dollars and
sixty five dollars in money to be paid to her by my executor
free from the Debts or disposition of her present or future
husband and at her death to her then living children.
Item 10 I will and bequeath to my daughter Mary Jane Hightower
a negro woman by the name of Sarah Sixteen years old yellow
complection one bed stead and furniture of her own selection
and the sum of one thousand and sixty five dollars in cash to
be paid to her by my Executor and if my said daughter should
die without any living child or children the property hereby
given to her to be equally divided between her brother and
sisters to wit: James F. Hightower, Naomi B. Butts, Emily B.
Almond, Eleanor Hightower and Epsy Hightower her full brother
and sisters.
Item 11 I will and bequeath to my Daughter Eleanor Hightower a
negro man by the name of Jepe. Twenty three years old dark
complection and eleven hundred dollars in money to be paid to
her by my Executor and if my said daughter Eleanor should die
without any living child or children the property thereby given
to her to go to her sister Epsy if in life if not in life then
to her other full brother and sisters named in item the tenth
clause of my will or other legal representatives also a bed
stead and furniture of her own choosing.
Item 12 I will and bequeath to my daughter Epsy Hightower a
negro girl yellow complection nine or ten years old by the name
of Amelia and fourteen hundred and sixty five dollars in money
to be paid to her by my Executor and if my said daughter Epsy
should die without any living child or children the property
hereby given to her to go to her sister Eleanor if in life, if
not in life, then to her other full brother and sisters named
in the tenth clause of this my will or to their legal
representatives also a bed stead and furniture of her own
choosing.
Item 13 I will and bequeath to my daughter Emily B. Almond wife
of Jepe F. Almond a negro woman yellow complection eighteen
years old with a blemish in one of her eyes now in the
possession of the said Jepe F. Almond her name not recollected
and the sum of eleven hundred and fifteen dollars in money to
be paid to her by my Executor free from the Debts or
Disposition of her present or a future husband and at her death
to the then living children.
Item 14 It is my will and desire that James F. Hightower my son
and Jepe G. Butts my son in law act as trustees for my two
daughters Eleanor and Epsy Hightower who are blind.
Item 15 I will and direct - that all my property both real and
personal not bequeathed or named in the foregoing clauses of
this my will of whatever nature it may be to be sold on a
credit of twelve months by my executor and the proceeds then of
after paying my just debts - to be applied to the payment of
the specific legacies named in money, in this my Last Will and
Testament, and if the property sold should not be sufficient to
pay the Specific Legacees herein named then each Legatee is to
lose equal in amounts if on the other hand there should be more
than enough to satisfy the Specific Legacies then the surplus
to be equally divided between all my then living children or
their legal representatives.
Item 16 I hereby constitute and appoint my son James F.
Hightower executor of this my last Will and Testament This 28th
day of July 1852.

Signed sealed and published by Daniel Hightower as his last
Will and Testament in the presence of us the Subscribers who
subscribed our names hereto in the presence of the said
Testator at his special instance and request and of each other
this 25th day of July 1852.
