Notes 
Individual:
James Heath sold property to John McClelland, Sr., recorded May 23, 1823. It being the first
recorded property in the newly created county of Wayne in N. Y. state.

On Feb. 17, 1817, he purchased of his father-in-law, John Austin, who that day purchased the whole
tract from the estate of John Johnston of Scotland of 653 acres.

AZUBA AUSTIN
James Heath married Azuba Austin in Cambridge, Washington Co., N. Y., vicinity and probably at
the home of her father near the "OLD STUMP CHURCH" at North Cambridge which is between
Cambridge and Easton. Sometime before April 20, 1812 this couple moved to the village of Lyons,
N. Y., as on this date their first child was born. We find them also living in the village of Lyons on
Feb. 17, 1817 when they purchased a farm from her father. Her father purchased the 653 acre tract
and at the same time they purchased from him their nearly 100 acre part of it. It is not definitely
known whether they moved the few miles from Lyons, N. Y., to their farm. They may never have left
Lyons until March 2, 1824 when records show they left Wayne Co. for Chautauqua Co., N. Y. It
appears that the Heaths used a year to find another, possibly more suitable farm. Records show they
were living there in 1838 and the actual farm and burial place was visited in May 1948. Their farm
was the whole of lot No. 2, in twp. No. 3, and range No. 12, being part of the Holland Purchase.
The
location is in Ellery twp. and west across the valley from Gerry, N. Y., on the Townline road. The
burial place is in the Old Gerry Cemetery about ?? 1/2 miles south of Sinclairville, N. Y.

The Wayne County property that was owned by the Heaths was sold to ??ohn McClelland on May
3, 1823 and was the first recorded deed in Wayne County after the county was organized. Original
deed and signatures are ??ow in the possession of the Wayne County Historical Society.

Ellery township records show that this family was the first Heath to set??le in that township.
