Case # 422, Equity , Wiliam Loveall and others vs. John [sic ] Loveall and
others. To the honorable Madison Nelson , a Judge of the circut court of
Carroll County sitting in Equity. The bill of complaint of William Lovell, Thomas Lovell, Matilda A.
and John W. Bowman her husband
M. Bowman, wife of John Bowman/John Lovell and Elias Lovell humbly
show unto your honor that a certain Mathew Lockard of Baltimore Co.,
[now Carroll Co.] departed this life On or about the year of our Lord
Eighteen Hundred and twelve and died intestate seized and possesed of
certain Real Estate lying and being situate in said Baltimore Co. [ now
Carroll Co. ] containing about ninety four acres of land more or less. The
said Mathew Lockard at the time of his death left the following named
children: Nancy, wife of Jehu Lovell, who is the mother of your
complainants, John Lockard, Thomas Lockard, Sarah Lockard, and William
Lockard which last two named were minors at the time of said Mathews
death. and your complainants further show that when the [said ] Sarah
Lockard and William lockard arrived at the age of twenty one years [ the
above ] land was equally divided amonge all the children of the said
Mathew Lockad, each receiving about Eighteen and three quaters of land
for which Deeds of partition were made executed and delivered to each
one for about the said number of Eighteen and three quaters acres of
land, but the deed to the said Nancy having been mislaid or lost was
never replaced in record, but the said Nancy Ann, Jehu Loveall/resided on
the said part conveyed to the said Nancy untill the said Nancys death
which was about Twenty five years after the said deed was executed ,
and the said Jehu now resides thereon from the death of his wife the
said Nancy untill the present time. And your complainants further show that the said Nancy , wife of the
said Jehu Loveall departed this life on or about the Tenth day of January
in the year of our Lord Eighteen Hundred and forty four leaving the
following named children: William Loveall, Thomas Loveall, Matilda A.
Bowman,wife of John W. Bowman, John Loveall, Juliann, wife of Daniel
Lampert, Sarah wife of George Harris. The said Julian Lampert departed
this life since the death of he mother the said Nancy Loveall on or about
the Fifteenth day of November Eighteen hundred fifty [ one crossed out ],
and the said Sarah Harris also departed this life since the death of her
mother the said Nancy Loveall on or about the twentieth day of January
eighteen Hundred and fifty tw-. the said Sahah Harris at the time of her
death left one child namely William Henry Harris an infant under the age
of twenty one years and the said Julian Lampert at the time of he death
left the following named children: Francis Henry Lampert, George Neff
Lampert, William James Lampert, and Charlotte Agnes Lampert all of
which are infants under the age of twenty one years. And your complainants further show that the said Jehu Loveall is still
living and your complainants are informed that the said Jehu Loveall has
a life estate in he said real Estate in the said real estate before
mentioned [ which was conveyed to the said Nancy and held by he by
upwards of twenty years befoe her death ] by the C---tesy of England and
is willing to renounce the same for an equitable portion of the proceedes
of the sale of the said land of Real Estate. And your complainants further
show that the said Jehu Loveall is old and very infirm and wholly unable
to take charge of and manage the said Real Estate and that it is now
causing waste and in a dilapidated condition yielding nothing whatever
and daily depreciating in value, and that it would not only be to the
interest of your complainants but also to the interest and advantage of
the infant childen of the said Sarah Harris,and the said Julian Lampert to
have the said land and Real Estate sold and the proceeds divided
amongst them but in as much as the children of the said Julian and Sarah
namely : Francis Henry Lampert, George Neff Lampert, William James
Lampert, Charlotte Agnes Lampert,and William Henrey Harris, are infants
under the age of twenty years , your complainants are advised that the
sale of the said Real Estate can not be had without the aid and
attesta----[of] your Honorable Court. To the end therefore that the infants namely, Francis Henry
Lampert, George Neff Lampert, William James Lampert, Charlotte Agnes
Lampert, and William Henry Harris and Jehu Loveall may??? the
premises; and that a decree may be had for the sale of the afore said
land and the proceeds of the said sale be distributed between the said
complainants and the infant defendants and the said Jehu Loveall in the
proportions to which each are intitled, and that your complainants may
have such such other and further relief as their case may require. May it please your Honor to grant unto your [ Complainants the writ
of subpoena against the said Jehu Loveall, Francis Henry Lampert,
George Neff Lampert, William James Lampert, Charlotte Agnes Lampert,
and William Henry Harris of --County comanding them to appear in this
county at some certain day to be therein named to and--- the premises ,
and abide by and perform ---cree as may be passed therein and as in
duly-- ---------------
